Mailbox Express sued by man who fell out of chair

GRETNA – A local copy store is being sued by a customer who fell out of a chair and was allegedly injured on the premises.

Joe Davis filed suit against The Mailbox Express LLC and Bankers Insurance Company in the 24th Judicial District Court.

Davis claims he had just made a copy at The Mailbox Express store located at 5860 Citrus Blvd. in Harahan and went to sit in an office chair when he fell backwards in the chair and it came out from underneath him. The plaintiff alleges he struck his left shoulder and head causing him severe injuries. Davis asserts he received severe personal injuries in the incident to his back, head, neck and left shoulder.

The defendant is accused of failing to properly maintain the premises in a safe condition, maintaining and contributing to the unsafe condition of the premises, failing to warn in any manner of the hazardous and dangerous area, failing to properly assemble office furniture and chairs, failing to fix and maintain furniture provided to patrons and failing to provide a safe place for visitors and residents to traverse.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, distress, medical expenses, surgery expenses and loss of wages.

Davis is represented by Anthony S. Taormina of Metairie-based Law Offices of Anthony Taormina.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
