Wind Run Apartment Homes allegedly exposed tenants to mold

NEW ORLEANS – The managers, operators and owners of Wind Run Apartment Homes are being sued by a tenant claiming exposure to mold and other irritants.

Shirley D. Bell filed a lawsuit against Wind Run Apartments LLC, Southwood Realty Company, Dominique Delpit and Leanne Yates in the Orleans Parish Central District Court.

Bell claims that during her stay at the defendant’s apartment homes she was exposed to mold and other irritants that caused her substantial health issues and ruined her movable property.  She claims that after notifying the defendants of the conditions no remedies were made available.

The defendant is accused of failing to properly maintain the property, failing to maintain the building in a safe condition, failing to take all precautions to avoid exposure to mold and other toxins and failing to correct an existing dangerous condition after repeatedly being put on notice.

An unspecified amount is sought for loss of earning capacity, loss of function, medical expenses, damages sufficient enough to compensate for ruined movable property and the expense of moving to another residence.

Counsel for the plaintiff is R. Brent Cueria of New Orleans-based Cueria Law Firm LLC.

This case has been assigned to Division J Judge Paula A. Brown.
