McDonald’s sued over slip-and-fall incident

NEW ORLEANS - A New Orleans woman is suing a fast food restaurant after allegedly being injured in a fall at a Canal Street location.

Elva Clavo filed a lawsuit against McDonald’s Corporation, CLB Investments LLC and Ozzie Ward, manager of the McDonald’s located on Canal Street, in the Orleans Parish Central District Court on Feb. 20.

Clavo claims that after exiting the bathroom of the defendant’s establishment she suddenly slipped and fell on a pool of water.

The defendants are accused of breaching their duty of care to petitioner in the form of failing to properly maintain their property, failing to maintain the bathroom area in a safe condition, failing to take precautions to avoid the accident, failing to discover and correct the dangerous condition and failing to warn patrons of the unsafe condition.

An unspecified amount is sought for pain and suffering, loss of function, anguish and medical expenses.

The plaintiff is represented by Attorney R. Brent Cueria of New Orleans.

This case has been assigned to Division H Judge Michael G. Bagneris.

Case no. 2013-01582.
