Woman who claims display of cranberry juice bottles fell on her sues grocery store

GRETNA – A Jefferson Parish woman is suing a the Westwego location of a national grocery store chain alleging she was injured when a display of juice bottles fell on her.

Donna Lopez filed suit against Winn-Dixie Montgomery LLC – Store #1431, Jerry Walker, “Carol," “Dale," an unknown cleaning company and their insurers in the 24th Judicial District Court on March. 18.

Lopez claims that she was shopping at the Winn-Dixie grocery store located at 1431 Westbank Expressway in Westwego when a bottle display of Ocean Spray Cranberry Juice fell on her as she was reaching for one of the bottles. The plaintiff alleges she received severe injuries in the incident.

The defendant is accused of failing to maintain a reasonable safe area for its patrons, failing to provide immediate assistance to the plaintiffs, failing to train its employees, failing to warn its patrons, reckless endangerment and reckless indifference.

An unspecified amount in damages is sought for physical disability, pain and suffering, mental pain and suffering, disruption of bodily tissues and cells and medical expenses.

Lopez is represented by Ron A. Austin of Harvey-based Ron Austin & Associates LLC.

The case has been assigned to Division O Judge Ross P. LaDart.
