CVS pharmacy sued by man who tripped over parking stop

GRETNA – A Jefferson Parish man is suing a a nationwide pharmacy chain for injuries he claims to have received after tripping over a parking stop in the parking lot of a local pharmacy.

Godfrey Downing filed suit against CVS Caremark Corporation, Caremark Louisiana Specialty Pharmacy LLC, CVS Enterprises and Louisiana CVS Pharmacy LLC in the 24th Judicial District Court on April 10.

Downing claims he was a customer at the CVS pharmacy located at 1801 Jefferson Hwy. in Jefferson and was walking through the parking lot when he tripped on a parking stop and fell to the pavement. The plaintiff alleges he received severe and disabling injuries in the fall.

The defendant is accused of not painting the parking stop yellow or another bright color so it could be distinguished from the rest of the parking area and failing to restrict access to the parking stop.

An unspecified amount in damages is sought for pain and suffering, disability, mental anguish, medical expenses and lost earning capacity.

Downing is represented by William R. Mustain III of Stanga & Mustain PLC.

The case has been assigned to Division B Judge Cornelius E. Regan.
