Hospital sued by woman struck by door

GRETNA – A Baton Rouge man is suing a local hospital after being knocked to the ground by an employee who opened door into her.

Terry Phillips filed suit against Ochsner Health System and their insurer in the 24th Judicial District Court on April 10.

Phillips claims she was in the medical records department near the front desk when an Ochsner employee opened a large heavy door and it struck her and knocked her to the floor. The plaintiff alleges that she suffered injuries in the incident to her neck and back, which required medical treatment.

The defendant is accused of failing to warn the plaintiff of the changes, failing to maintain the premises in a safe and reasonable condition and failing to repair the swinging door when it knew or should have known its dangerous condition.

An unspecified amount in damages is sought for personal injury, pain and suffering, mental anguish, loss of enjoyment of life, disability, emotional anguish, mental anguish, loss of income and impairment of earning capacity.

Phillips is represented by attorney Douglas M. Schmidt of New Orleans.

The case has been assigned to Division H Judge Glenn B. Ansardi.
