GRETNA – A woman who had just walked out of credit union and was struck by a piece of debris thrown from an electric company worker is suing.
Stacy Ann Frisco filed suit against the New Orleans Firemen’s Federal Credit Union, Cumis Insurance Society Inc., Kastner Electric Company Inc. and United Fire and Casualty Company in the 24th Judicial District Court on April 16. Frisco claims she had just walked out of the New Orleans Firemen’s Federal Credit Union on April 26, 2012 located at 4401 W. Napoleon Ave. in Metairie when a large piece of broken sign was dropped onto her. The plaintiff alleges the object was dropped by an employee of Kastner Electric and that she received injuries in the incident.
The defendant is accused of failing to adequately and properly secure parts of the sign to prevent wind from blowing the sign to the ground, failing to properly secure and install sign parts, failing to maintain a safe place of business, failing to keep entrance and exit safe, allowing entrance and exit of the business to remain dangerous, failing to protect the plaintiff from unreasonable risks, failing to inspect and keep the premises in a safe and suitable condition for the customers of the defendant, failing to discover an dangerous condition, failing to take steps to prevent a dangerous condition from causing injury, creating a dangerous condition, negligent installers, failing to secure parts to signs in windy weather and failing to act as a reasonable or prudent person.
An unspecified amount in damages are sought for physical pain and suffering, mental anguish, aggravation, annoyance, disability, discomfort, mental anguish, annoyance, medical expenses, loss of enjoyment of life, loss of use and function of body parts, bodily disability, impairment of psychological funding, disability from engaging in recreation, destruction of earning capacity, loss of support, loss of society and loss of consortium.
