Bottom Line Bar and Grill sued by customer who stepped in hole in parking lot

GRETNA – A Jefferson Parish man who was allegedly injured after he stepped into a hole outside of a local bar is suing the bar and its landlord.

Alberto Caceras filed suit against 735-737 St. Joseph St. LLC, 3309 Division LLC, Fleur De Lis Acquisitions LLC, Bottom Line Sports Bar and their insurers in the 24th Judicial District Court on April 29.

Caceras claims he was a guest at Bottom Line Bar and Grill located on Division Street in Metairie when he was talking to a friend outside of the establishment and stepped backwards and his right foot and ankle fell into the hole. The plaintiff alleges he received serious and disabling injuries in the incident.

The defendant is accused of failing to maintain areas traversed by pedestrians, failing to inspect and maintain proper upkeep of public premises, failing to observe the hazard, failing to take all reasonable care and caution under the circumstances and failing to warn patrons.

An unspecified amount in damages is sought for physical pain and suffering, emotional distress, mental anguish, loss of earnings, lost earning capacity, medical expenses and loss of enjoyment of life.

Caceras is represented by Vincent P. Scallan of the Metairie-based Calluda Law Firm.

The case has been assigned to Division B Judge Cornelius E. Regan.
