GRETNA – A Jefferson Parish woman recovering from spinal surgery claims she was injured at a Home Depot store when an employee ran into her cane with a cart.
Tammy L. Guillot, and husband Jerry, filed suit against The Home Depot Inc. and its insurer in the 24th Judicial District Court on May 1.
Guillot claims she was shopping for a refrigerator at the Home Depot located at 4600 Lapalco Blvd. in Marrero when a cart being operated by an employee struck her walking cane causing her to lose her balance and violently twist her body. The plaintiff alleges she had just undergone a back surgery requiring the partial removal of part of her vertebrae and that the incident resulted in injuries to her back, neck and legs.
The defendant is accused of failing to warn patrons of potential dangers, failing to properly train and supervise employees, failing to maintain a proper lookout, failing to operate the cart with reasonable control when knowing that patrons were present, failing to use reasonable vigilance and operating a cart in careless manner.
An unspecified amount in damages is sought medical treatment, great pain, mental anguish, loss of sleep and proper rest and medication.
