GRETNA – A Gretna-based Chinese buffet restaurant is being sued on behalf of two customers who allegedly received food poisoning after drinking tainted sodas.
Gloria Breaux and Michelle Allen, on behalf of her minor child, filed suit against Chopstix Buffet LA Inc. and their insurer in the 24th Judicial District Court on May 2.
Breaux and Allen claim they went out to eat with Allen’s minor daughter at Chopstix Buffet located at 15 Westside Shopping Center in Gretna when Breaux and Allen’s daughter were served discolored Sprite soda. The plaintiffs allege that after they drank the soda they found a slimy substance at the bottom on one of the cups and that Breaux and Allen’s daughter later became violently ill and suffered from ailments including nausea, severe stomach cramps and vomiting.
The defendant is accused of failing to exercise reasonable care, providing patrons with bad product that was tainted and dangerous and causing injury to the plaintiffs.
An unspecified amount in damages is sought for physical pain and suffering, attorney’s fees, medical expenses, emotional distress, loss of pursuit of happiness and loss of enjoyment of life.
The plaintiffs are represented by Pius A. Obioha of the New Orleans-based Law Offices of Pius A. Obioha.
The case has been assigned to Division N Judge Stephen D. Enright Jr.
