GRETNA – A Jefferson Parish woman is suing a local retail store claiming she is permanently disabled after tearing her rotator cuff in a fall on the store’s premises.
Margarite Blair filed suit against Wal-Mart Louisiana Inc. in the 24th Judicial District Court on May 2.
Blair claims she was shopping in the paint aisle at the Wal-Mart located at 8912 Veterans Memorial Blvd. in Metairie when she slipped on a substance that had been spilled on the floor. The plaintiff alleges she reached out for a cart as she fell and as a result fell on her right shoulder tearing her rotator cuff. Blair asserts she was severely injured in the incident.
The defendant is accused of allowing a hazard to exist on the premises, failing to warn patrons of a danger, allowing water to remain on the floor in an area highly traveled by patrons and failing to maintain property so as to render it safe for patrons.
An unspecified amount in damages is sought for mental anguish, personal injuries, medical expenses, physical pain and suffering, mental pain and suffering, permanent disabilities, impairment of earning capacity, loss of wages and inconvenience.
