GRETNA – The children of a man who was killed at sea are suing the company he was working for at the time.
Brandi and Thelma McGlothern, individually and on behalf of and as personal representatives of the deceased Randy Harris, filed suit against Total Marine Services of Jefferson Inc. in the 24th Judicial District Court on May 10.
The McGlotherns claim that Harris was employed as a full seaman on May 16, 2012 when he was attempting to secure a stray vessel and was killed in the process. The plaintiffs allege their father fell in the water while trying to retrieve the boat and drowned.
The defendant is accused of breach of a legally imposed duty of reasonable care, failing to provide a reasonably safe place to work, failing to properly train and supervise the deceased, failing to take any means or precautions for the safety of the defendant, creating and maintaining an unseaworthy vessel, failing to provide minimum safety requirements and failing to provide adequate equipment and personnel for the job in question.
An unspecified amount in damages is sought for survival damages, loss of economic support, emotional pain and suffering due to the loss of their father and punitive damages.
The McGlotherns are represented by Timothy J. Young of the New Orleans-based the Young Firm.
The case has been assigned to Division L Judge Donald A. Rowan Jr.
