NEW ORLEANS – A woman is suing a local retailer after she claims to have been severely injured by merchandise that fell on her head from the second floor of the store.
Janneh Brazile filed suit against Simone Dejan and Bed Bath & Beyond Inc. in the Orleans Parish Central District Court on June 28.
Brazile claims that Dejan, an employee of the defendant, was moving a ladder on the second floor of the store, which then caused merchandise to fall from shelving. The merchandise hit Brazile in the head and neck area causing injuries, the suit claims.
The defendant is accused of failing to provide a safe premise, failing to properly supervise and train employees when performing activities involving ladders and negligence.
An unspecified amount in damages is sought for the cost of general and special damages including physical pain and suffering, medical expenses and potential loss of future earning capacity.
Brazile is represented by attorney James E. Vinturella of New Orleans.
The case has been assigned to division M Judge Paulette R. Irons.
