GRETNA – A man who alleges he was beaten up by a drunken baseball bat wielding bar patron is suing the man accused of the assault and the bar for injuries he claims he received in the incident.
Terrance Bright, and wife Lydia, filed suit against James S. Leone, Buffalos Billiards, Jude West and their insurers in the 24th Judicial District Court on June 4.
Bright claims he was a guest at Buffalos Billiards Bar located at 3624 Airline Drive in Metairie on the early morning of June 9 when West allegedly beat him with a baseball bat. The plaintiff claims West’s actions were in part due to the fact he had been drinking alcoholic beverages served to him by the bar even though he was underage. Bright asserts he received severe and life threatening personal injuries in the attack.
Buffalos Billards is accused of negligently selling alcoholic beverages to an underage person, failing to use due care in checking ID for underage purchases and allowing underage drinking on the property and negligence by establishing a pattern of encouraging underage purchases to buy alcohol and ignoring state laws.
West is accused of assaulting the plaintiff with a weapon, negligent injury with malice and possessing and consuming alcohol with the intent of intoxication that led directly to the confrontation with the plaintiff.
An unspecified amount in damages is sought for mental pain and suffering, physical pain and suffering, permanent damage to the body, permanent orthopedic damages, anguish, medical expesnes, loss of earning capacity and permanent total disability.
