GRETNA – A Mississippi glass company is suing the owners of a local franchise restaurant for non-payment.
Capital Glass Company Inc. filed suit against NOLA Wings Veterans LLC, Compleat Hospitality Management, Barnes Inc. of Mississippi, Paoli Inc., MFWMD LLC, L.C.S. Investments LLP and Severn & Veterans LLC in the 24th Judicial District Court on June 11.
Capital Glass Company Inc. claims it was contracted for $42,869 to install glass, windows, mirrors, glass fixtures, glazing, aluminum composite panels frames and other materials in the Buffalo Wild Wings that was being built at 3434 Veterans Blvd. in Metairie.
The plaintiff alleges it prepared for the project and submitted a shop drawing to Barnes Inc. along with three applications and certifications for payment. Capital Glass Company Inc. asserts that after it did not receive any payment it was notified that NOLA Wings Veterans and Compleat Hospitality Management would complete the work.
The plaintiff claims it was later given a check in the amount of $15,835.55 for the first and second applications for payment and in addition were given two subsequent payments of $6,795 and $1,495.
The defendant is accused of breach of contract.
Damages in the amount of $33,828.45 in addition to attorney’s fees and costs are sought by the plaintiff.
