Apartment complex sued by woman who claims defective handrail resulted in fall down stairs

GRETNA – A Harvey property owner is being sued by a woman who claims she was injured after falling down a flight of stairs when a defective handrail failed.

Brittney Johnson filed suit against the Residence at Park Avenue LLC, Howard Eymar and their insurers in the 24th Judicial District Court on June 13.

Johnson claims she was walking down a flight of stairs at the Residence at Park Avenue located at 2129 Hyde park Ave. in Harvey when the a defective handrail failed and she fell down the stairs. The plaintiff alleges she was seriously injured in the incident.

The defendant is accused of failing to maintain a reasonably safe area, failing to provide immediate assistance to plaintiff, failing to train employees, failing to warn patrons, reckless endangerment and failing to correct a defective condition.

An unspecified amount in damages is sought for loss of enjoyment of life, physical disability, pain and suffering, mental pain and suffering, disruption of bodily tissues and cells and medical expenses.

Johnson is represented by attorney Ron A. Austin of Harvey.

The case has been assigned to Division I Judge Nancy A. Miller.
