Wholesaler sues tobacco store for alleged non-payment of $21K

GRETNA – A Harvey-based wholesaler is suing a tobacco store for allegedly not paying for items they ordered and received from them.

Frank Silva and Sons LLC filed suit against Geat Inc. and Smokey’s Discount Tobacco in the 24th Judicial District Court on June 27.

Frank Silva and Sons LLC claims that they sold and delivered products, including cigarettes, tobacco products, dry good and grocery items, to Geat Inc. and Smokey’s Discount Tobacco. The plaintiff alleges that the defendant did not make payments for some of the goods that they sold them despite making a written demand.

The defendant is accused of breach of contract.

Damages in the amount of $21,191.51 plus attorney’s fees are sought by the plaintiff.

Frank Silva and Sons LLC is represented by Kevin R. Truxillo of New Orleans-based Garrison, Yount, Forte, Mulcahy & Lehner LLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
