Recycling facility sued by two after crane accident

NEW ORLEANS – Two men are suing a recycling company after they were allegedly injured in an incident involving a crane operated on its premises.

Gerard Perez and Gary Morgan filed suit against Southern Recycling LLC, EMR USA Holdings LLC , Southern Scrap Recycling-HOUMA Inc. and their insurers in the Orleans Central District Court on July 12.

The plaintiffs claim that while they trying to remove scrap metal from a trailer located at 4801 Florida Ave., a crane got stuck to the trailer, which was attached to Perez’s truck. The attached crane allegedly lifted and shook the trailer before striking the rear of the Perez's truck, injuring both Perez and Morgan .

The defendant is accused of negligence for improperly entrusting a crane, failing to properly train employees, and having unsafe practices and operation of business. An unspecified amount is damages is sought for pain and suffering, physical impairment, lost wages and medical expenses.

The plaintiff is represented by attorney Marie A. Bookman of New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
