Sewerage and Water Board sued by woman who allegedly ran over manhole cover

NEW ORLEANS – A woman who allegedly totaled her vehicle after striking a manhole cover that was in the middle of a road is suing the Sewerage and Water Board of New Orleans. 

Citadel Insurance Co., as subrogee of Tonisha Ambeau, filed suit against the Sewerage and Water Board of New Orleans in the Orleans Parish Civil District Court on July 9.

Citadel Insurance Company claims that Ambeau was driving on Downman Avenue in New Orleans when she ran over a Sewerage and Water Board manhole cover that was left in the middle road. The plaintiff alleges in her car was severely damaged in the collision and that her air bag deployed.

The defendant is accused of creating an unreasonably dangerous condition, failing to properly and adequately secure the manhole cover, failing to properly and adequately warn traffic of the foreign object in the roadway and failing to adequately maintain the manhole cover.

An unspecified amount in damages is sought for medical expenses, vehicle damages and Ambeau’s deductible amount.

Citadel Insurance Co. is represented by attorney Jacob L. Tramontin of New Orleans.

The case has been assigned to Division A Judge Tiffany G. Chase.
