Veteran’s Hospital sued by woman claiming nerve damage

NEW ORLEANS - A resident of St. John the Baptist Parish has filed a lawsuit against the New Orleans Veterans Hospital claiming she suffered nerve damage due to the hospital’s alleged improper care.

Simon Brown filed the suit against on Aug. 9 in federal court in New Orleans.

Brown fell and injured herself on July 29, 2011 and sought treatment at the emergency room at Ochsner Hospital. She was placed in a sling and was given medication. She followed up with the VA Hospital in New Orleans. Ultimately, the VA Hospital placed a cast on her, which allegedly caused severe nerve damage.

The defendant is accused of violating the Louisiana Medical Malpractice Act for improper care and treatment and for breaching the applicable standards of care.

The plaintiff is seeking an award of damages for $500,000 for physical pain, mental pain and anguish, permanent scarring, disfigurement, medical expenses, loss of use, loss of enjoyment of life, interest, and court costs.

Brown is represented J. Michael Daly, Jr. and Bradford H. Walker of Walker Daly, LLP in Metairie. A jury trial is requested.

U.S. District Judge Jane Triche Milazzo is assigned to the case.
