NEW ORLEANS - A deckhand filed suit against Bertucci Contracting Co. on Aug. 2 in federal court in New Orleans.
Plaintiff Frankie A. Pittman claims the incident occurred on Aug. 10 while he was making up tow to a barge.
The defendant is accused of negligence for permitting Pittman to reach across the barge to the pushknee of the Capt. Anthony to grab a facewire that he claims was far too heavy to be lifted by a single deckhand, failing to provide Pittman with a reasonable means for accessing the facewire and extending it across to the barge without risking injury, failing to provide Pittman with assistance, and for failing to conduct a proper Job Safety Analysis.
The plaintiff is seeking an award of damages for mental anguish, lost earnings, loss of earning capacity, disfigurement, physical impairment, medical expenses, physical pain and suffering, maintenance and cure, interest, punitive damages, attorney’s fees, and court costs.
Pittman is represented by Houma attorney Joseph L. Waitz, Jr.
U.S. District Judge Eldon E. Fallon is assigned to the case.
