NEW ORLEANS - An Orleans Parish woman has filed a lawsuit against a grocery store claiming she suffered injuries when she sat in a chair and it broke.
Lillian Brumfield filed suit against Winn-Dixie Montgomery d/b/a Winn-Dixie and XYZ Insurance Co. on Sept. 12 in federal court in New Orleans.
The alleged incident occurred on March 14 while Brumfield was a customer at Winn-Dixie located on Holiday Drive in New Orleans. Brumfield states she was sitting in a chair, when the chair suddenly broke. According to the lawsuit, Brumfield suffered severe and painful injuries.
The defendants are accused of negligence for failing to properly maintain its premises, failing to properly train its employees, failing to properly supervise its employees, failure to adequately inspect property and/or premises, and failure to correct of a known defective/hazardous condition.
The plaintiff is seeking an award of damages for physical and mental pain and suffering and disability, medical expenses, scarring and disfigurement, loss of enjoyment of life, disability and loss of function, interest and court costs.

U.S. District Judge Kurt D. Engelhardt is assigned to the case.
