Contractor files suit against subcontractor for alleged incomplete, inadequate work

NEW ORLEANS – A contracting company alleges that concrete work it subcontracted to another company was abandoned before its completion.

Construction South Inc. filed suit against NOLA Concrete & Construction LLC in the Orleans Parish Civil District Court on July 12.

NOLA Concrete & Construction is accused of breach of contract for abandoning work on the project and for the deficiency of the limited amount of work actually completed.

The plaintiff company and its president, Conrad Appel III, claims that the services contracted to the defendant, a company owned by Cedric Mitchell, in connection with the construction of a Canal Street Blood Center included cast-in-place concrete with a concrete slab first floor foundation, and concrete work on the second to fifth floors for a total of $117,543. The plaintiff was forced to complete the work when NOLA Concrete & Construction allegedly abandoned the work. The cost to the plaintiff exceeds the sums due to the defendant.

An undisclosed amount is sought for all sums reasonably due to Construction South as a result of the breached contract and according to the subcontract agreement from July 2011, interest from the date of judicial demand, costs, attorney’s fees and all other reasonable relief as determined by the court.

The case has been assigned to District M Judge Paulette R. Irons.
