Wal-Mart sued by woman who tripped on pallet containing watermelons

GRETNA – A New Orleans woman is suing Wal-Mart alleging she received serious injuries when she tripped on a pallet in a local store.

Phebie B. Henderson filed suit in the 24th Judicial District Court on Aug. 2.

Henderson claims she was shopping at the Wal-Mart located at 5110 Jefferson Hwy. in Jefferson when she reached over to pick a watermelon off a crate and her foot got caught in the pallet the watermelons were sitting on, causing her to fall to the floor. The plaintiff alleges that she sustained numerous injuries in the incident that required medical treatment, including injuries to her lower back, shoulder, knees and wrists.

The defendant is accused of creating a danger, failing to provide a safe place to shop and failing to warn of the dangerous condition.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering and medical bills.

Henderson is represented by attorney Paul C. Miniclier of New Orleans.

The case has been assigned to Division J Judge Stephen C. Grefer.
