GRETNA – A Kenner condominium homeowner association is being sued by one of their homeowner for allegedly poor upkeep of the common areas that have led to property damage in his unit.
Justin Farber filed suit against Chardonnay Village Condominium Association Inc. and their insurer in the 24th Judicial District Court on Aug. 16.
Farber claims he purchased a unit in the Chardonnay Village Condominium Association on Feb. 29, 2012.
The plaintiff alleges that under the law and contract the homeowner association is liable to maintain the common areas of the condominium and that they did not provide proper repairs to the building despite severe damage due to hurricanes.
Farber asserts the within the same month of his purchase the interior of his condo unit was damaged. The plaintiff claims that he pays $301.95 per month and that the association as a whole takes in $78,500 per month from 277 members in the association and has $702,495.50 in escrow.
The defendant is accused of failing to meet their obligation to members and breach of contract.
An unspecified amount in damages is sought for anxiety, restlessness, irritability and loss of happiness.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
