GRETNA – An apartment complex is being sued by a family of tenants who were allegedly exposed to toxic mold.
Mariana Rivera, individually and on behalf of her minor children, filed suit against AIG Insurance Coolidge-CLK St. Germaine LLC and St. Germaine Apartments in the 24th Judicial District Court on Aug. 23.
Rivera claims she and her children were exposed to toxic mold when they were living at the St. Germaine Apartments located at 2201 Manhattan Blvd. in Harvey. The plaintiff alleges she notified the manager that the property was in poor condition, but they never made a move to correct the issues. Rivera asserts that she and her children experienced health issues connected to the toxic mold including flu-like, sinus and pulmonary problems.
The defendant is accused of failing to maintain its property, failing to repair the subject property, failing to repair its property to prevent it from being a hazard to others and total disregard of the welfare of the tenant.
An unspecified amount in damages is sought for medical expenses, loss of insurability, physical pain and suffering, mental anguish, emotional distress, physical disability, loss of enjoyment of life, exert cost and the costs of those proceedings.
Rivera is representing herself pro se in the lawsuit.
The case has been assigned to Division M Judge Henry G. Sullivan Jr.
