Jefferson Parish sued by employee who had stroke at work

GRETNA – A parish government worker who suffered a stroke while on the job is suing his employer for not immediately calling for medical assistance.

Richard Hall, and wife Enester, filed suit against Jefferson Parish Drainage Department in the 24th Judicial District Court on Aug. 29.

Hall claims he was working as a field laborer for the Jefferson Parish Drainage Department on April 16, 2012 when he suffered a stroke. The plaintiff alleges that instead of calling 911 his supervisor told him to go sit in the work truck to recuperate. Hall asserts his supervisor later said he had undergone training to identify strokes, but that in this particular situation he felt like he made the correct decision.

The plaintiff claims his stoke progressed to the point when it was too late to reverse the damage that had occurred. Hall alleges his wife found him in a debilitated state and she took him to the hospital where he was diagnosed with a stroke.

The defendant is accused of negligence for not calling 911 as soon as Hall began to experience health problems.

An unspecified amount in damages is sought for medial expenses, lost earnings, pain and suffering and mental anguish.

Hall is represented by Patrick H. Patrick of New Orleans-based Patrick Miller LLC.

The case has been assigned to Division G Judge Robert A. Pitre Jr.
