Convenience store sued by woman who claims she was injured when a chair she was sitting in collapsed

GRETNA – A convenience store is being sued by a woman who claims she was injured when the back of a chair collapsed when she sat in it.

Cassandra Moses filed suit against Sammy Discount Mart LLC and their insurer in the 24th Judicial District Court on Sept. 21.

Moses claims that she visited the Sammy Discount Market at 3912 Metairie Heights in Metairie on April 15 to purchase a money order and that as she was waiting for service she sat in a chair that broke and she fell out of it. The plaintiff alleges she was injured in the incident after she struck her head on the floor as well as her shoulder and back. Moses asserts that soon after the incident she also began to have headaches.

The defendant is accused of failing to use reasonable care to keep the premises in a safe condition, creating an unreasonably dangerous area, not notifying of the dangerous area and not providing janitorial services.

An unspecified amount in damages is sought for personal injury, medical expenses, pain and suffering, diminished quality of life and economic loss.

Moses is represented by attorney Max M. Chotto of Gretna.

The case has been assigned to Division G Judge Robert A. Pitre Jr.
