Condo association sued by woman who alleges injury due to missing steps

GRETNA – A woman who was visiting a friend at a local condominium complex is suing after she was allegedly injured in a fall in a parking lot.

Quanell Carter filed suit against Edenborn Courts Limited Partnership, Edenborn Courts Gardens and Liberty Surplus Insurance Corporation in the 24th Judicial District Court on Oct. 9.

Carter asserts she was visiting a friend at Edenborn Courts located at 312 Edenborn Ave. in Metairie when she was leaving a walkway and had to step down to the parking area.  The plaintiff alleges that the bottom two stairs were missing which caused her to fall to the ground and sustain a serious injury.

The defendant is accused of failing to provide a safe egress from the property, failing to repair the stairway by replacing the missing step, exceeding the maximum vertical rise for each step in violation of law and failing to place a warning sign on an exceedingly high riser.

An unspecified amount in damages is sought for physical pain and suffering, emotional distress, mental anguish, medical expenses and other functional overlays and disorders.

Carter is represented by attorney Burton G. Klein of Metairie.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
