Audio company sued by couple for allegedly taking money and not finishing audio installation

GRETNA – A New Orleans couple is suing a local audio company over its alleged failure to deliver all system components and complete installation of products that were mostly paid for.

Sophia Griffies and Scott Griffies M.D. filed suit against S.M.I.L.E. Inc., SMILE NOLA Inc. and Leo Golubitsky in the 24th Judicial District Court on Nov. 12.

The Griffies allege that they contracted S.M.I.L.E. Inc. to install a whole house audio system for their condominium at 536 Bienville St. in New Orleans for $20,000. The plaintiffs assert they made a 30 percent deposit in the amount of $6,000 on Aug. 17, 2012 with the balance to be paid upon completion and homeowner training and that the job would be completed within 30 days. The Griffies claim that three months after they made the deposit the installation was not completed and S.M.I.L.E. Inc. made demand for $12,000 more which they paid. The plaintiffs allege that over a year afterward they had only received delivery of the audio equipment that was not installed by the defendants.

The defendant is accused of breach of contract, failing to complete work for the contract performed, failing to supply the contracted equipment and conversion of funds.

An unspecified amount in damages is sought for loss of $18,000, inability to rent the condominium due to lack of audio equipment and attorney’s fees.

The Griffies are represented by Jeffrey M. Siemssen of Metairie-based Nicaud & Sunseri LLC.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
