Allegedly defective post-operative shoe prompts lawsuit

NEW ORLEANS – A woman who was ordered to wear a special shoe after foot surgery filed suit claiming the shoe was defective.

Rene Andrews filed suit against Breg Inc. in the Orleans Parish Civil District Court.

The suit states that on Oct. 23, 2012, the plaintiff underwent foot surgery to remove a wart. As part of her post-operative care, she was prescribed to wear a special shoe that would allow her to continue walking on her surgically repaired right foot. The shoe was manufactured and marketed by Breg Inc.

On November 5, 2012, the plaintiff allegedly attempted to stand up from a seated position, when the bottom of the shoe came apart, causing the plaintiff to fall and fracture her left ankle.

The defendant is accused of manufacturing and selling a product containing a defect, failing to warn and being otherwise negligent.

The plaintiff seeks an unspecified amount in damages for mental and physical pain and suffering, mental anguish, emotional distress, medical expenses, loss of earning capacity and other damages.

The plaintiff is represented by attorney Laurence Cohen of New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
