Orleans Parish Sheriff’s Office sued after deputy allegedly rear-ends couple

GRETNA – A local sheriff’s office is being sued by a couple who claim they were injured when a sheriff's deputy ran his cruiser into the back of their car.

Gaylynn and Perry Rankin filed suit against Orleans Parish Criminal Sheriff’s Office, State Farm Mutual Automobile Insurance Co. and Russell Rhodes in the 24th Judicial District Court on Dec. 9. 

The Rankins claim they were driving their car on Lapalco Boulevard in Marrero when an Orleans Parish Sheriff’s Office cruiser driven by Rhodes ran into the back of their vehicle. The plaintiffs assert the driver of the vehicle that struck them was using the vehicle in the scope of his employment at the time. The Rankins both claim they received severe back injuries in the accident.

The defendant is accused of failing to maintain a proper lookout, failing to have vehicle under control, failing to use reasonable diligence, carelessness, inattention, negligence, violation of law and failing to stop vehicle to prevent the accident.

An unspecified amount in damages is sought for pain and suffering, permanent disability, emotional pain and suffering, mental anguish, medical bills, doctor bills, hospital bills and drug expenses.

The Rankins are represented by attorney Christopher M. Rodriguez of New Orleans.

The case has been assigned to Division O Judge Ross P. LaDart.
