Clearview Mall customer sues over slip and fall in oil and water

Clearview

GRETNA – A woman who claims she was severely injured in a slip and fall on an oil and water mixture on the floor of a local mall is suing numerous companies she claim are responsible.

Gwendolyn H. Brown filed suit against State Farm Fire & Casualty Company, United Franchises Inc., Wow Café & Wingery, Richards Clearview LLC and ABM Janitorial Services – Southeast LLC in the 24th Judicial District Court on Dec. 23.

Brown alleges that on Jan. 2, 2013 she entered the Clearview Mall located at 4436 Veterans Blvd. in Metairie when she slipped in a mixture of cooking oil and water. The plaintiff asserts that the liquids were spilled on the floor by employees of United Franchises Inc. and Wow Café & Wingery. Brown claims that she received severe and disabling injuries in the fall.

The defendant is accused of allowing a condition to exist, creating or having actual constructive notice of the condition, failing to exercise reasonable care, failing to make a reasonable effort to keep the premises free of hazards and failing to warn the plaintiff of an unreasonably dangerous condition.

An unspecified amount in damages is sought for physical pain and suffering, emotional distress, inconvenience, mental anguish, medical bills, lost wages and impairment of earning capacity.

Brown is represented by attorney James B. Guest of Kenner.

The case has been assigned to Division L Judge Donald A. Rowan Jr.

Case no. 734-078.
