Homeowner and insurer sue over malfunctioning water pump that flooded home

GRETNA – A home insurer and one of its customers whose home was flooded are suing a water pump manufacturer after a pump is alleged to have failed.

Encompass Insurance Company and James D. Fleming II filed suit against Aga Marvel in the 24th Judicial District Court on Jan. 21.

Encompass Insurance Company claims that a water pump manufactured by Aga Marvel and installed at Fleming’s home at 422 Atherton St. in Metairie failed causing flooding to the home.

The defendant is accused of violating the terms of the Louisiana Products Liability Act, producing a product that is unreasonably dangerous in construction and failing to properly manufacture the water pump.

An unspecified amount in damages is sought for repairs to the residence, legal interest, court costs and attorney’s fees.

The plaintiffs are represented by Donna M. Johnson of Alexandria-based Armour Law Firm.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
