Property insurer sued for allegedly not covering home fire

GRETNA – The owners of a Harvey home that was damaged in a fire are suing their property insurer for not covering the damages.

Louis E. Ussin and Regina L. Mitchell filed suit against Southern Fidelity Insurance Company in the 24th Judicial District Court on April 2.

Ussin and Mitchell assert that they had homeowner’s insurance through Southern Fidelity Insurance Company when their home located at 2639 Oakmere Drive in Harvey caught fire on April 8, 2012. The plaintiffs allege the blaze resulted in their home incurring smoke, water and fire damage and included the loss of personal property as well.

Ussin and Mitchell claim they have made repeated requests for payment, but have not been paid the amounts needed to fully repair the residence.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for all losses.

Ussin and Mitchell are represented by Matthew K. Brown of New Orleans-based Sullivan Stolier Knight LC.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.

Case no. 737-107.
