GRETNA – A contractor is being sued by a homeowner over a contract that was to be completed more than a year ago.

Sean Avent filed suit against NOLA Service Pros LLC in the 24th Judicial District Court on April 7.

Avent asserts he entered into a contract on March 13, 2013 with NOLA Service Pros LLC which was to provide demolition, termite remediation and renovations on his home located at 3913 Bissonet Dr. in Metairie that was to be completed by April 17, 2013.

The plaintiff alleges that after additions to the contract the total amount the defendant charged for the work was $35,242.90 of which he has made payments that have amounted to $24,980.28.

However, Avent claims that on June 19, 2013 he sent an email to NOLA Service Pros LLC concerning its alleged lack of performance on the project and requesting a full and complete update of the progress. The plaintiff asserts he sent numerous follow up emails requesting a firm date for completion after the initial completion date had passed, asking why no one had worked on the home in a few weeks and notifying the defendant that the home had failed a termite inspection.

The defendant is accused of not completing work, exceeding scope of contract by doing too much demolition, failing to remove all termite damaged wood, failing to replace wood in accordance with law, failing to complete electrical wiring work, failing to install a new electrical panel, discarding original doors and failing to complete the contract in time.

An unspecified amount in damages is sought for loss of rental income and losses due to non-compliance with contract.
