Jolly’s restaurant sued in trip and fall over electrical box

NEW ORLEANS – A local restaurant is being sued after a customer tripped and fell on the way to pick up take out.

Monica Robinson filed suit against Maloney Sept LLC, Jolly’s Restaurant & Banquet Hall  and Sharon Henry, the lessee and restaurant manager of Jolly’s Restaurant as well as their respective insurance providers in the Orleans Civil District Court.

Robinson alleges that on April 11, 2013, she went to purchase and pick up food she had ordered from Jolly’s restaurant located at 5000 Old Gentilly Road in New Orleans when she tripped over an unmarked and raised electrical box in the entryway, causing her to fall and suffer severe injuries.

The defendant is accused of allowing the existence of unsafe conditions, failing to warn about deficiencies and hazards on property, and not fixing the hazard on the property.

Robinson is suing for damages including medical expenses, pain and suffering, emotional distress and physical injuries which include herniated discs in the neck, herniated discs in the back, a torn rotator cuff, knee injuries and a trauma induced cataract. She is also suing for lost wages, inconvenience, loss of enjoyment of life and permanent disability.

The plaintiff is represented by attorneys Anthony D. Irpino and Justin A. Reese of New Orleans.

Case is assigned to Division N Judge Ethel S. Julien.
