GRETNA – A man is suing a driver he alleges ran into him with her vehicle as he helped students into vehicles in an elementary school parking lot owned by the Jefferson Parish school system.
Gregory R. LeRouge filed suit against Xuan Nguyen, 21st Century Centennial Insurance Company and Allstate Property and Casualty Insurance Company in the 24th Judicial District Court on May 6.
LeRouge asserts that on May 8, 2013 he was assisting students being picked up from the car pool lanes at Geraldine Boudreaux Elementary School located at 950 Behrman Highway in Terrytown when a 2004 Toyota RAV4 driven by Nguyen struck him. The plaintiff claims he was injured in the incident.
The defendant is accused of failing to maintain a proper lookout, failing to maintain reasonable vigilance, failing to maintain control of a vehicle, failing to take into account safety of others, failing to use reasonable care for the operation of a motor vehicle, failing to act as a reasonable and prudent person, failing to observe and obey traffic conditions, failing to obey and observe traffic laws, acting in a reckless and careless manner, disregarding the safety of others and failing to avoid the collision.
An unspecified amount in damages is sought for injuries to his right ankle, physical pain and suffering, emotional distress, mental anguish, anxiety, inconvenience, nervousness, loss of enjoyment of life, inability to perform normal and usual functions, disability and rehabilitation expenses.
