GRETNA – A Jefferson Parish couple is suing an international car dealer over a car they purchased that allegedly had significant problems.

Diana and Aurelius George Lowe filed suit against Best Chevrolet Inc. in the 24th Judicial District Court on May 21.

The Lowes claim that on Aug. 17, 2007 they bought a 2006 Lexus from Best Chevrolet for $31,619.83. The plaintiffs allege that unbeknownst to them, when they purchased the vehicle it had been deemed a lemon, meaning it had significant mechanical defects from when it was manufactured. The Lowes assert that Best Chevrolet had purchased the vehicle at auction at which time it had been noted on its title as a lemon and when Best Chevrolet had the title reissued it removed the notation.

The plaintiffs claim that on July 20, 2013 when they attempted to trade in the vehicle they were informed it had previously been branded a lemon. The Lowes allege that had they been aware of the vehicle’s history and the fact that an issue would arise when they attempted to sell the vehicle they would have never purchased it. The plaintiffs assert that the vehicle is now worthless to them as they are unable to sell it.

The defendant is accused of breach of warranty, quanti minoris, fraudulent inducement into a contract, breach of contract, intentional misrepresentation, breach of good faith performance, breach of fiduciary duty and unfair and deceptive trade practices.

An unspecified amount in damages is sought for rescinding the sale of the property to the plaintiffs and reduction of price of purchase of the vehicle.

The case has been assigned to Division I Judge Nancy A. Miller.
