Pedestrian who claims she was injured in fall though open manhole sues

GRETNA – A woman who claims she was severely injured after falling through an open manhole is suing the local sewer district where the incident occurred.

Lori Bulter filed suit against Jefferson Parish Consolidated Sewerage District No. 1 of the Parish of Jefferson State of Louisiana, Consolidated Sewerage Districts of Jefferson Parish, Louisiana Department of Transportation and Development and Jefferson Parish Drainage Department in the 24th Judicial District Court on May 28.

Bulter claims she was walking on Westbank Expressway in Marrero when she fell through an unsecured manhole. The plaintiff alleges she was severely injured in the incident including an injury to her right knee which may require surgical intervention.

The defendant is accused of failing to maintain a metal cover over the hole, failing to institute proper inspection procedures to protect pedestrians, failing to warn of a dangerous condition, failing to properly train employees in maintenance, allowing a dangerous condition to exist and violation of state law.

An unspecified amount in damages is sought for physical pain and suffering, emotional pain and suffering and medical bills.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
