Homeowner sued by company who allegedly paid her mortgage as part of purchase contract

NEW ORLEANS – A New Orleans woman is being sued after allegedly agreeing to sell her home while facing default but refusing to convey the title of the home once the agreed purchaser helped her pay off her mortgage.

Burnett Property Development filed suit against Charlene James in the New Orleans Parish Civil District Court on March 17.

Burnett Property has asserted they came to an agreement with James on a contract for sale of a property she owned. Burnett Property also asserts they made down payments to ensure the defendant would not default on her mortgage of the property before they purchase it. However, Burnett Property asserts that when the time came for James to convey the title of the property to them she refused to do so.

The defendant is accused of failing to convey the title to a property she agreed to sell to the plaintiff.

The plaintiff is seeking a specific performance in the form of conveyance of good and merchantable title by the defendant.

The plaintiff is represented by Matthew A. Moeller from The Moeller Firm LLC of New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.

Case no. 2014-02681.
