GRETNA – A local private school is being sued by a student who claims he was not allowed to graduate because it failed to provide his transcripts to a school he transferred to even though he had earned the necessary course credits to do so.
David and Darlene Torry, natural tutors for a minor child, filed suit against Knights Academy & High School in the 24th Judicial District Court on June 4.
The Torrys assert their son was a student at Knights Academy and High School where he attended classes through the first semester of 12th grade. He then transferred to Miller McCoy Academy. The plaintiffs claim their son had attended the required amount of classes and received the necessary grades on his tests to achieve passing grades that should have allowed him to pass, but that the defendants refused to provide his transcripts to his new school. The Torrys contend that their son hand delivered a request for his transcripts to be transferred, but the records were never provided and he was not allowed to attend graduation.
The defendant is accused of depriving the student of an opportunity to further his education.
An unspecified amount in damages is sought for loss of earnings and income, mental pain and suffering and expenses.
The Torrys are represented by New Orleans-based attorney Charles V. Cusimano III.
The case has been assigned to Division D Judge Scott U. Schlegel.
