Homeowners sues for alleged breach of contract for Hurricane Isaac damages

GRETNA – A Kenner couple is suing their property insurer for allegedly not covering damages to their home that occurred during a hurricane.

Latifa and Said Raki filed suit against ASI Lloyds in the 24th Judicial District Court on June 3.

The Rakis claim they had an insurance policy issued by ASI Lloyds on their home located at 3316 Irish Bend Road in Kenner in the amount of $202,000 for the dwelling, $4,040 for other structures and $40,400 for loss of use. The plaintiffs assert they paid an annual premium of $2,575 for the period of Aug. 2, 2012 through Aug. 26, 2013 and that on Aug. 29, 2012, Hurricane Isaac struck the area and damaged their home. The Rakis allege the storm resulted in damage, most notably to the property’s roof.

The plaintiffs contend that the defendant failed to properly adjust the damages on the property and estimated the damages at only $1,350. The Rakis claim they could not properly repair the damage and prevent future damage.

The defendant is accused of breach of contract, bad faith claims handling, negligent claims handling, non-prompt payment, violating state law and negligent misrepresentation.

An unspecified amount in damages is sought for diminution in value of property, repair and remediation expenses and increased expenses, amount due not previously paid, cost to hire investigative and engineering firms, mental anguish, loss of use and attorney’s fees.

The Rakis are represented by Shelly R. Hale of New Orleans-based Speights & Worrich.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
