Lessees with lease/purchase option on home file suit after terms of contract allegedly change

Breach of contract

GRETNA – A couple of lessees who claim their lease/purchase agreement on a local home was changed over a year after they entered into are suing the home’s former owners.

Don Landry and Don Paul Landry filed suit against Martha Byrne and the estate of Charles Byrne in the 24th Judicial District Court on June 4.

The Landrys claim on Oct. 1, 2012 they entered into a a lease agreement with the defendants with an option to purchase a home located at 809 Matador Drive in Terrytown. The plaintiffs claim they put a $10,000 down payment on the home and did $65,000 worth improvements and were paying a monthly rent on the property. The Landrys assert that on Nov. 11, 2013 the defendants changed the terms of the lease agreement resulting in them being $20,000 in debt on the property and that shortly afterward the home was sold to a company that is financing the home for the plaintiffs.

The defendant is accused of breach of contract.

Damages in the amount of $20,000 are sought by the plaintiffs.

The plaintiffs are represented by attorney Max M. Chotto of Gretna.

The case has been assigned to Division D Judge Scott U. Schlegel.
