GRETNA – A veterinary clinic is suing a telecommunications provider it claims falsely penalized it for canceling its telecommunications contract.
Pet Care Center Inc. filed suit against Windstream Communications Inc. and Brown & Joseph in the 24th Judicial District Court on May 23.
Pet Care Center Inc. contends Windstream Communications Inc. provided it with voice and data network services when it gave notice of transferring services to Cox Communications. It claims that Windstream then sent notice of early termination charges in the amount of $3,696 due immediately. The plaintiff claims it asked numerous times for the early termination fee to be removed from its bill, but still received several letters and a call from someone with Brown & Joseph who said they were an attorney representing Windstream–when the call actually originated from a collection agency. Pet Care Center Inc. claims the defendant made material false statements to cause loss or inconvenience to them.
The defendant is accused of violating the Louisiana Unfair Trade Practices and Consumer Protection Act.
An unspecified amount in damages is sought for payment of duplicative costs and fees for telecommunication services, expenses and time incurred responding to false claims, attorneys fees and costs, mental anguish and humiliation.
Pet Care Center Inc.is represented by Jeffrey A. Clayman of New Orleans-based James Ryan III & Associates LLC.
