Construction company sues, claims lack of compensation for work on Juvenile Justice Center

NEW ORLEANS – A Covington construction company is suing its contractors and the City of New Orleans for allegedly failing to pay an outstanding balance of $51,381.00 for labor and materials expended while completing the Youth Study and Juvenile Justice Center.

Davis Construction of Covington LLC filed suit against True Wall Enterprises LLC, Liberty Mutual Insurance Company, The City of New Orleans and The McDonnel Group LLC in the Orleans Parish Civil District Court.

Davis Construction claims it was contracted by True Wall Enterprises to provide materials and/or labor for the Juvenile Justice Center in New Orleans.

According to the suit, True Wall Enterprises was sub-contracted by The McDonnel Group, which had entered into a Public Works Contract with the City of New Orleans. The McDonnel Group had allegedly procured a labor and material payment bond from Liberty Mutual for the purpose of completing the youth facility.

On July 26, 2013, Davis Construction asserts it filed a sworn statement with the Clerk and Recorder of Mortgages for the Parish of Orleans confirming the amount due on the project. The finished statement was allegedly delivered to the defendants.

The defendants are accused of failing to repay Davis Construction in any amount for the balance owed.

The plaintiff is seeking to recover the original $51,381.00 with interest, including all costs incurred due to legal proceedings, attorney’s fees, and the costs of filing the sworn statement.

Davis Construction is represented by attorney Conor T. Lutkewitte of Favret, Demarest, Russo & Lutkewitte.

The case has been assigned to Division N Judge Ethel S. Julien.
