NEW ORLEANS – A Folgers Coffee plant worker is suing Smucker’s for alleged negligence resulting in injury due to a forklift accident.
Shawanda Butler filed suit against Folgers’ parent company, Smucker Foodservice Inc., and the employee in question in the Orleans Parish Civil District Court on May 19.
Butler claims that on July 19, 2013, she was employed at the Folgers Coffee plant on Chef Menteur Highway in New Orleans. The plaintiff asserts that she was bringing an empty pallet back to a designated location, when the forklift operator present backed the forklift up, striking Butler.
Butler contends that she sustained injuries due to the incident, including a fractured foot and a laceration on her leg.
The defendant is accused of negligence by failing to properly supervise employees and failing to provide a reasonably safe working environment.
The plaintiff is seeking an unknown amount in damages for pain and suffering, lost wages and medical expenses. Butler is also seeking reparations for mental anguish, emotional distress and loss of enjoyment of life.
Shawanda Butler is represented by lawyer Robert L. Campbell of Williamson, Fontenot & Campbell LLC.
The case has been assigned to Division J Judge Paula A. Brown.
