Aeropostale stores sued by customer allegedly injured by falling sign

GRETNA – A local clothing retailer is being sued by a customer who claims she was injured when a sign fell on her.

Deidra Jones filed suit against National Fire Insurance Company of Hartford, Aeropostale Inc., Greater Lakeside Corp., Causeway LLC of Delaware and another unknown insurer in the 24th Judicial District Court on June 19.

Jones contends she was shopping at the Aeropostale store located in the Lakeside Shopping Center in Metairie on Nov. 29, 2013 when an overhead sign was knocked down by a store employee and struck her. The plaintiff claims she was severely injured in the incident.

The defendant is accused of failing to maintain a reasonably safe place, failing to take necessary measures to protect safety of visitors, failing to properly maintain the premises, failing to warn visitors and residents of the danger, failing to take steps to avoid the incident, failing to see what should have been seen and failing to properly train and supervise employees.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical expenses, loss of earnings, loss of earning capacity, loss of enjoyment of life, permanent disability, loss of consortium and attorney’s fees.

Jones is represented by Anthony J. Milazzo II of the New Orleans-based Law Offices of Edward J. Womac Jr. & Associates.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
