NEW ORLEANS – A local production company is being sued by a contractor for allegedly failing to repay profits lost due to negligence on the production company's part.
CGCD Enterprises filed suit against Stage Right Productions and Doss H. Berry III in the Orleans Parish Civil District Court.
CGCD claims that it hired Stage Right Productions and its owner and operator, Berry, on Jan. 17, 2009 to produce, raise, and eventually retire a 50 x 50 foot sign to promote Bonnie Boyd and Company, a client of CGCD's.
Bonnie Boyd and Company purportedly agreed to pay $30,996 for the project. CGCD asserts that it contracted with Stage Right to produce, install, and tear down the sign for a total of $10,000. The plaintiff claims that it paid a deposit of $5,000 to Stage Right Productions.
On Jan. 21, 2009, Stage Right delivered and erected the sign, says the suit. CGCD alleges that the sign collapsed and collided with a vehicle within 12 hours. The plaintiff further claims that the sign fell as a direct result of Stage Right's negligence, resulting in the loss of CGCD's contract agreement with Bonnie Boyd and Company and the expected $35,000 profit.
CGCD asserts that Stage Right and Berry have failed to repay the $5,000 deposit or any sum towards the $35,000 loss.
The defendant is accused of negligence and fault, constituting breach of contract between Stage Right and CGDC.
The plaintiff seeks an unknown amount in damages to include a refund of the deposit paid, loss of profit, costs and attorney fees.

The case has been assigned to District M Judge Paulette R. Irons.
