GRETNA – A man is suing Coca-Cola after he was allegedly injured when he tripped over a case of soda left on the floor of a store.
Manuel J. Randazzo filed suit against Diaz LLC, Mandebay Center, Arsenal LLC, Scottsdale Insuracne Company and Coca-Cola Refreshments USA Inc. in the 24th Judicial District Court on July 9.
Randazzo alleges that he was with his wife at the Mandebay Center located at 2595 Florida St. in Mandeville when his wife was assisting him in walking to the bathroom and he tripped over a five-gallon case of Coca-Cola soda syrup concentrate. The plaintiff contends that he received serious injuries in the fall.
The defendant is accused of failing to give warnings of a dangerous condition, failing to properly inspect and maintain the area, failing to warn of inherent danger, failing to do what was necessary to keep the area safe, failing to provide a safe area for employees, failing to properly supervise and instruct employees, allowing a hazardous condition or defect to exist and placing boxes in the area where they were placed.
An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental pain and suffering, physical disability, physical disfigurement and scarring, loss of enjoyment of life, loss of wages and loss of earning capacity.
